Delaware adopted the Uniform Common Interest Ownership Act (Del. Code tit. 25, §81-101 et seq.) to provide a standardized legal framework for condominiums, cooperatives, and planned communities. This statute establishes the fundamental rights and obligations of both homeowners and associations, covering everything from governance and voting to assessments and enforcement procedures.

Under Delaware's UCIOA, associations must follow specific procedures when enforcing covenants and imposing fines. Homeowners are entitled to written notice of any alleged violation and must be given a reasonable opportunity to cure the issue or request a hearing. The statute also imposes fiduciary duties on board members, requiring them to act in good faith and in the best interests of the association as a whole.

Delaware courts have generally upheld HOA covenants as enforceable contracts, but they have also recognized that boards must exercise their authority reasonably. If a board acts in an arbitrary, capricious, or discriminatory manner, homeowners can seek judicial relief. Delaware's relatively small size means that many HOA disputes are resolved through informal negotiation or mediation, which can be faster and less expensive than litigation.
